  Conservation of construction and termination of construction

The decision to preserve or completely stop construction is made by the investor in the following cases:

- highlighting the insufficient amount of capital investments for the planned period;

- outdated design solutions and technological processes;

- major damage due to natural disasters;

- lack of balanced capacity of the local construction organization;

- unaccounted for in the project of local construction conditions.

This decision should indicate the reasons that caused conservation, the procedure for selling material values ​​and equipment imported for construction, to be used during the conservation and dismantling period, when construction is stopped; the name of the organization responsible for the preparation of the construction site for conservation and the protection of the work performed and the structures or the constructed ZiS during the conservation and the possibility of using structures, buildings and their parts when construction is completely stopped.

In case of conservation, the time and conditions of conservation shall be specified, and when the construction is completely stopped, the procedure and terms for the liquidation of the construction shall be given.

At the same time, the contractor issues an order or decides on the procedure for termination (preservation) of construction and installation works, on the implementation of safeguard measures for structures and parts of the ZiS, for the construction of material assets and mechanisms for another construction by the organization, on the use of material values ​​delivered to the construction site.

After the conservation decision has been taken, the developer has to:

1) notify the contracting construction organization of the conservation (termination) of construction. In the absence of such a notice, the date of termination of work shall be considered the date of exclusion from the plan of cap. construction of the higher organization of the customer-developer;

2) with the participation of a representative of a construction company, a general contractor, a subcontractor organization, draw up an act of inventory of facilities, completed works with a list of the volumes of necessary measures and activities ensuring the safety of construction started with ZiS;

3) to accept, according to the act from the contractor, on time as agreed by the parties, but not later than 2 months from the date of suspension of the work, mothballed or discontinued construction objects or their part of ZiS, as well as available material values ​​that the contractor cannot use in construction objects;

4) to identify the loss of suppliers of process equipment and materials included in the customer’s supply (equipment costs, backlog of parts, parts, semi-finished products) in connection with the full or partial cancellation of the order for these products and take measures to compensate the supplier for these losses;

5) within two months, pay for the actual amount of work completed, reimburse the contracting organization for losses incurred due to cancellation and amendment of the contract for the supply of construction materials and equipment, as well as costs associated with transportation of property to other construction sites;

6) make a calculation of waste costs to be approved by the investor and written off in connection with conservation;

7) to develop, under a separate agreement with the project organization, design and estimate documentation for conservation, safeguard measures; if necessary, for re-entry with an indication of the estimated cost, deadlines and specific artists;

8) to coordinate with the contracting construction organization an estimate for construction and installation work related to the preservation of objects whose construction has been mothballed, as well as for repair and restoration work on the said objects necessary for re-conservation;

9) to transfer, by an act of the contracting construction organization, facilities, the construction of which was resumed after conservation, indicating their technical condition on the day of transfer (acts, estimates, calculations and other technical documentation on conservation is subject to approval by the authority deciding on conservation).

The implementation of the construction and installation works, as stipulated by the conservation budget, must be carried out without fail by the same contracting organization under the supplementary agreement and the general contract.
