In April 1993. the order of GOSKOM Property and GOSSTROY of Russia approved the provision on contract bidding in the Russian Federation.

Depending on the tendering process conducted by the organizer, the main types can be: with or without prequalification, with the participation of foreign providers, public or private, primary and repeated.

The decision on the appointment and time of the auction is made by the customer after the approval of the project or after the development of working documentation.

Bidders:

1. The customer - at the time of the decision to hold tenders must have the necessary investment resources (or the right to dispose of them at the required time), confirmed by relevant financial documents, for example: credit agreement, bank reference, decree of state authorities. The customer must have the status of a legal or natural person with the appropriate registration and the right to fulfill the obligations of the customer.

During the auction, the customer performs the following functions:

- appoints the organizer of the auction

- supervises the work and participates in the work of the tender committee through its representative

- establishes the final terms of the contract and concludes it with the winner.

2. The organizer of the auction - the person who is entrusted by the customer to conduct the auction. Must have the status of a legal entity and a license for the right to bid. Carries out the following functions:

- prepares documents for the announcement of bidding

- carries out the publication of announcements or sending out invitations.

The announcement of the auction should be published 2-6 months prior to their conduct.

In addition, he forms a tender committee, directs and monitors its activities and involved engineering and consulting organizations for the preparation of tender and necessary documentation, collects and analyzes offers, approves the results, accepts appeals and bears all costs of bidding.

3. The tender committee is a permanent or temporary body created by the organizer or customer of the bidding. This is a complex body, formed by the organizer and customer from its representatives, as well as expert and consulting organizations, can attract representatives of the federal agency for construction. It is a working body; accepts, opens and evaluates submitted offers, determines the winners of the auction. If bidding with prequalification, he develops or orders the development of prequalification documentation.

4. Applicant - the company under whose name the application is made. Applicants, regardless of their form of ownership, with work experience, registered in the Russian Federation and expressing written consent to participate in tenders are allowed.

Prequalification - a procedure for determining the technical and economic, organizational and other potential capabilities of the applicant to perform the contract put up for bidding.
